Data Recovery Master hereby reminds you specifically that before installing the series products of Data Recovery Master and using its services, please read this User Agreement (hereinafter referred to as the "Agreement") carefully to ensure that you fully understand all clauses herein. Please read prudently and choose to accept or reject this Agreement. You may not use the services covered by this Agreement unless you accept all clauses of this Agreement. Your acts including but not limited to detection, consultation, use and order submission shall be deemed acceptance of this Agreement and your consent to be bound by all clauses hereof. If you are under the age of 18, please read this Agreement accompanied by your legal guardian.

1.1 This Agreement is concluded between you and Data Recovery Master. "Data Recovery Master" refers to Data Recovery Master software and its possible operating affiliated entities related to relevant services. A "User" means any person who uses services provided by Data Recovery Master, and is mostly referred to as "you" in this Agreement.

1.2 The licensed content under this Agreement includes, but is not limited to, data detection and consultation for Android mobile devices provided to users by Data Recovery Master (hereinafter referred to as the "Services").

1.3 Data Recovery Master may update this Agreement at any time. The updated agreement clauses shall supersede the original ones upon publication without further notice. You may review the latest version of the agreement clauses on this website. If you do not accept the revised clauses after Data Recovery Master modifies them, please stop using the Services immediately. Your continued use shall constitute acceptance of the revised agreement clauses.

2.1 In the course of using the Services, you need to fill in or submit certain necessary information, such as identity and registration information required by laws, regulations, rules and normative documents (hereinafter collectively referred to as "Laws and Regulations"), as well as device and operation information submitted for better use of the Services. If the information you submit is incomplete or fails to comply with Laws and Regulations, you may be unable to use the Services or may encounter restrictions in using them.

2.2 Data Recovery Master undertakes to strictly keep confidential your personal privacy information submitted to Data Recovery Master, including your real name information, phone numbers, email addresses, mailing addresses, third-party platform account information and other personal information.

2.3 We will adopt technical measures and other necessary measures to secure users' personal privacy information and prevent the collected personal privacy information from being leaked, damaged or lost under the Services. If such incidents occur or we detect potential risks of such incidents, we will take remedial measures in a timely manner.

2.4 Data Recovery Master may cooperate with third parties to provide relevant services for users. In such cases, Data Recovery Master may provide users' registration materials and other information to such third parties provided that the third parties undertake the same personal information protection obligations as Data Recovery Master. Once you register, log in to or use Data Recovery Master Services via a third-party platform account, any use by Data Recovery Master of information recorded by such third-party platform shall be deemed to have obtained your full consent and acceptance.

2.5 Data Recovery Master shall not disclose or reveal users' personal privacy information to any third party without your consent, except under the following specific circumstances:

(1) Where Data Recovery Master is required to provide such information by judicial or administrative authorities in accordance with legal procedures;

(2) Information leakage caused by you disclosing or sharing your personal privacy information with others, or information leakage arising from other causes not attributable to Data Recovery Master;

(3) Where you voluntarily disclose your personal privacy information to third parties;

(4) Information leakage caused by hacker attacks, computer virus intrusions and other force majeure events.

2.6 You agree that Data Recovery Master may use your personal privacy information for the following purposes:

(1) Identity verification: account login verification to prevent unauthorized access to the Services.

(2) Statistical analysis: analyze and compile statistical information related to the use of our products and Services so as to improve our products and Services.

(3) Product and service delivery: maintain, improve and develop our Services.

(4) Important notifications: send you important notices, such as personal service information and amendments to this Agreement.

(5) Other matters: other matters stipulated by applicable Laws and Regulations.

3.1 When providing online network services, Data Recovery Master may charge fees for part of its services. Data Recovery Master will clearly indicate the charging standard for each service. If you refuse to pay such fees, Data Recovery Master has the right to withhold the relevant services.

3.2 The engineer appointment services you obtain by submitting an order are provided exclusively for the person submitting the order. Engineers will contact you according to the contact information you provided when submitting the order and render paid services accordingly.

3.3 You shall ensure that the devices and data to be operated on by engineers when providing services are legally owned by yourself.

3.4 Data recovery is a nonphysical service and nonreversible. Once data recovery is completed and confirmed, the paid service shall be deemed fully performed, which shall mean you are satisfied with the service result. No refund application will be accepted for subsequent accidents or dissatisfaction with recovery results. In addition, once the number of computers covered by membership packages is authorized, such authorization cannot be cancelled.

3.5 Multiple packages are available within the Data Recovery Master application. You are advised to fully understand the differences among packages before making payment and purchase services after gaining relevant understanding. All service fees are nonrefundable. Data recovery function service fees are charged based on data recovery outcomes. After engineers inform you that your data is recoverable and you pay the function service fee, engineers will conduct final data recovery upon confirmation of your successful payment.

3.6 After you select services and complete payment, regardless of package type, engineers will try their best to contact you within the promised service period. If engineers fail to reach you after multiple attempts, your order service period will be postponed. The service time can be reconfirmed based on further communication with engineers. If engineers cannot reach you and you fail to take the initiative to contact them, your order will remain postponed until you get in touch. Data Recovery Master shall not bear any liability for failure of data recovery or service nonperformance caused by your personal reasons.

3.7 Prices for data recovery function service fees and labor fees may be adjusted along with fluctuations of labor costs and changes in data-recovery difficulty. Price adjustments shall not be notified individually to new or existing users.

3.8 VIP membership services are exclusive to the account-holding user. At no time shall you transfer, sublicense or authorize any part or all of VIP membership benefits to any third party other than yourself in any way.

3.8.1 You are strictly prohibited from renting, lending or transferring your VIP membership account to third parties in any form, including but not limited to account subleasing, resale and sharing via ecommerce platforms, social software, offline transactions, account-sharing tools and other channels.

3.8.2 You shall not activate membership services for yourself or others through any of the following improper means:

(1) Activating membership services for yourself or others for profitmaking or business purposes beyond reasonable personal use;

(2) Activating membership services for yourself or others by means of robot software, spider software, crawler software, screen-brushing software, automated scripts or other programs;

(3) Activating membership services for yourself or others through fraud, sham transactions, malicious brushing transactions, misappropriation of other people's information or other improper means that violate the principle of good faith;

(4) Activating membership services for yourself or others through nonofficial channels other than official designated channels of Data Recovery Master (including official websites, authorized software, official cooperative platforms, etc.);

(5) Activating membership services for yourself or others by infringing intellectual property rights, trade secrets of Data Recovery Master or the legal rights including name right, privacy right and property right of others;

(6) Activating membership services for yourself or others by other means in violation of applicable laws, administrative regulations, departmental rules, national policies and public order and good morals.

3.8.3 VIP membership services are virtual online goods provided under the model of payment prior to service. Membership fees correspond to the price of purchased membership services and shall not be deemed advance payments, deposits, earnest money or savings. Except for special circumstances specified below, once activated, VIP membership services are nontransferable and nonrefundable (except for cases such as material defects of VIP membership services rendering them completely unusable caused by Data Recovery Master's breach of contract, otherwise stipulated in this Agreement, mandatory refund requirements under Laws and Regulations, or refund approvals at the sole discretion of Data Recovery Master).

3.8.4 If Data Recovery Master detects or receives third-party reports and verifies that users conduct account renting, lending or transferring as specified in Article 3.8.1, or activate membership services in violation of Article 3.8.2, Data Recovery Master may, according to the severity of violations, take measures including but not limited to issuing warnings, restricting membership functions, freezing membership accounts, terminating membership services and revoking membership permissions, and recover illegal gains. All paid membership fees shall be nonrefundable. Meanwhile, users shall compensate for all losses incurred to Data Recovery Master (including but not limited to direct economic losses, indirect economic losses, rights-protection costs, litigation fees, attorney fees, etc.). Where such acts may constitute crimes, Data Recovery Master will report to competent authorities in accordance with law.

4.1 In case of force majeure events beyond the control of Data Recovery Master, such as government acts, that render Services unavailable, we will notify users as soon as possible, but shall not be liable for any losses suffered by users and will not refund prepaid labor fees.

4.2 If you breach or are deemed to breach any provision of these Service Terms, we have the right to immediately terminate all services you have purchased without prior notice.

4.3 Our failure or delay in exercising any right under this Agreement shall not constitute a waiver of such right. Partial or single exercise of any right under this Agreement shall not preclude the exercise of any other right. We reserve the right at any time to require you to perform your obligations and bear corresponding liabilities for breach of contract.

5.1 This product cannot guarantee 100% recovery of lost data. Data may fail to be recovered under the following circumstances:

(1) Partial or complete data loss caused by bad disk sectors of the data to be recovered;

(2) Inaccessibility of the data to be recovered due to disk damage;

(3) Overwriting of the data to be recovered by newly written data due to delayed recovery attempts;

(4) Failure to log in to the software caused by no internet access on computers;

(5) Data subject to multiple deletion or formatting operations;

(6) Other scenarios of unrecoverable data confirmed by engineers to be unrelated to software defects.

No refund applications will be accepted for the abovementioned circumstances.

6.1 To avoid disputes arising from failure to recover expected data after purchasing this product, users may preview documents prior to purchase to judge whether documents can be fully recovered. Please complete recovery operations only after confirming that file contents are previewable. Refunds will be granted only under the following conditions:

1. Engineers remotely record a video showing file-recovery failure with Data Recovery Master and the whole process of successful recovery using other data-recovery products.

2. Engineers remotely capture screenshots showing that target files cannot be found under the file-search path in Data Recovery Master while such files are retrievable under the corresponding path with other data-recovery products.

3. If files involve privacy, users may take the aforesaid steps to obtain videos or screenshots on their own.

7.1 The formation, performance, interpretation and dispute resolution of these Service Terms shall be governed by the laws of the People's Republic of China. If any provision of these Service Terms is held invalid due to conflict with prevailing laws of the People's Republic of China, such invalidity shall not affect the validity of remaining provisions.

7.2 Any dispute arising out of or in connection with this Agreement shall first be settled through friendly negotiation. If negotiation fails, either party may file a lawsuit with the people's court at the place where the operator of Data Recovery Master is located.
